Aviquali Privacy Policy

The Privacy Policy and the Cookie Policy of the Website are entered into by and between EDITUM, a simplified joint stock company under French law with its registered office at 7, rue Meyerbeer - 75009 PARIS, with a share capital of 5,267.00 euros, registered in the Paris Trade and Companies Register under number 807 543 350, and represented by Mr. François-Marie Charmet as Chairman (hereinafter referred to as "Aviquali"), and Aviquali's legal entity customers browsing and/or using the https://www website. aviquali.com/ (hereinafter referred to as the "Website") (hereinafter referred to as a "User").
Aviquali may change its privacy policy, its cookie policy and the terms of use of the Website, especially to comply with applicable laws and regulations. The User will be informed of any changes and their effective date. By browsing the Website from this date, the User is deemed to have accepted these changes.
Aviquali suggests that users consult the privacy policy and the cookie policy regularly.


I. PRIVACY POLICY

Aviquali collects data about Users when they browse the Website in compliance with the terms of this privacy policy (the "Privacy Policy").
Terms used in the Privacy Policy that begin with a capital letter have the following meaning.
"Parties" means both Aviquali and the User.
."Personal Data" means Personal Data as defined in the Personal Data Protection Law.
"Law relating to the protection of Personal Data" means the law in force concerning Personal Data, namely (i) Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms, in its version effective on the date of this Agreement, and (ii) European Regulation No. 2016-679 on data protection, known as the "GDPR".

 

1. How we process your Personal Data

Aviquali is responsible for the processing of Users' Personal Data and acts in accordance with the Legislation on the protection of Personal Data.
The personal data collected by Aviquali includes the surname, first name, telephone number and email address of Users. Data relating to the use of the Website, such as IP address, may be collected automatically through actions on the Website, including through the collection of cookies and other tracking devices as detailed below.detailed below.
Aviquali processes Personal Data in accordance with the following purposes and legal basis.

2. Recipients and hosting conditions of your Personal Data

Aviquali processes Personal Data in a confidential manner and with the utmost care, limiting access to it to employees authorized to process it in the course of their duties.
Personal Data is hosted in the European Union by a service provider whose identity and contact details are specified in the Website's Legal Notice.
Aviquali may share Personal Data with:
- third party service providers engaged by Aviquali to perform subcontracted tasks. In any case, these service providers are only allowed to use Personal Data for the purpose of the service they provide on behalf of Aviquali, and only for the purposes set out in this Privacy Policy;
- public bodies or authorities upon request, to comply with a legal obligation or to protect rights.

3. Where and how long your personal data is stored

Aviquali makes every effort to keep Personal Data within the European Union. In the event that Personal Data is stored on servers located in non-EU countries, Aviquali guarantees that the country or countries in which the Personal Data is stored will provide an adequate level of protection under the Data Protection Law.
Aviquali only keeps Personal Data for the purpose for which it was collected and for the time necessary to process requests when the data is collected via the contact forms available on the Website, or twelve (12) months in case of data from browsing the Website. Personal Data may be kept for marketing purposes for a maximum of three (3) years after the last communication with Aviquali. At the end of this period, Personal Data will be archived for the prescription period corresponding to criminal and administrative actions, notwithstanding the User's right to erasure of data, upon request.

4. Users Rights

Each User may, at any time and on simple request:
- require that their Personal Data be communicated, completed, updated or deleted;
- withdraw their consent to the processing of their Personal Data, which will not affect the lawfulness of the processing based on the consent before its withdrawal;
- benefit from the right to data portability and the right to define instructions on the fate of his/her Personal Data in the event of the User's death; and/or
- request the limitation of or object to the processing of their Personal Data on legitimate grounds.

Aviquali may request proof of identity to process the request. Aviquali s'engage à faire ses meilleurs efforts pour répondre dans un délai d'un (1) mois à compter de la réception de la demande de l'Utilisateur. This period may be extended by a further two (2) months depending on the complexity and number of applications. Aviquali will keep the User informed in this case.
The User may also file a complaint with the CNIL if he/she believes that the protection of his/her Personal Data has not been ensured during the processing carried out by Aviquali.
